So the pharmaceutical manufacturer of Mevacor argues that since it owns the rights to the ingredient lovastatin which is the same ingredient that is found naturally in the red yeast rice, therefore selling the red yeast rice is tantamount to their patent impingement by the red yeast rice traders.

In the case of lovastatin, the FDA banned the supplements because they are “identical to a drug and, thus, subject to regulation as a drug.” That is very convenient for the drug company, which now charges monopoly rents on the product — which can increase prices at ridiculous levels as shown above where 1kg of red yeast rice once in a bottle shoots to over $374.
